Best Light Beta Terms

Who these terms are between

These terms are between you and Sally Slater, who makes Best Light ("we" and "us"). They cover the beta (test) version of the Best Light Mac app and its download. By ticking the box on the beta page, or by installing or using the beta, you agree to them. If you don't agree, don't download or use the beta.

You must be 18 or older to use the beta.

What the beta is

The beta is an early version of Best Light, given free so we can test it before it goes on sale. It may have bugs, crash, slow your Mac, stop working during a call, or change or lose your saved looks. Don't rely on it for anything important, and check how you look before a call that matters.

We may change the beta, send updates, or end the beta at any time, with or without notice. When the beta ends, the beta version may stop working. Taking part doesn't promise you a free or discounted copy of the finished app, unless we tell you so in writing.

What you may do

We give you a personal, non-exclusive, non-transferable right to install and use the beta on Macs you own or control, for as long as the beta runs. We keep all rights in Best Light, including its code, design, makeup drawing and name. These terms don't give you any of them except the right to use the beta.

The videos and pictures you make with Best Light are yours.

What you may not do

• Share the download, your download link or the app with anyone else, or post them anywhere. Anyone who wants the beta can sign up on our website.
• Copy, sell, rent, lend or give away the app.
• Decompile, disassemble or reverse engineer the app, or try to get at its code, models or artwork, except where the law allows it in spite of this limit.
• Use the app, or anything it makes, to train, test or improve an artificial intelligence or machine learning model.
• Change the app, get around its protections, or make other programs feed pictures into the Best Light camera.
• Use the app to break the law, or to deceive, harass or impersonate anyone.

Feedback

If you send us ideas, suggestions or bug reports, we may use them freely to improve Best Light, without paying you or naming you. Please don't send us anything you consider confidential.

Privacy

Best Light does all of its face and video work on your Mac and sends nothing off it. To give you the beta, we keep your email address, the version of these terms you agreed to, when you agreed, and the download link we emailed you. Our privacy policy explains what we collect and how we use it.

No warranty

THE BETA IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE BETA WILL BE ERROR-FREE, SECURE OR UNINTERRUPTED.

Limit on our liability

TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOST BUSINESS OR DAMAGE TO REPUTATION, ARISING FROM THE BETA OR THESE TERMS, EVEN IF WE WERE TOLD THEY WERE POSSIBLE. OUR TOTAL LIABILITY FOR ANY CLAIM ABOUT THE BETA OR THESE TERMS IS LIMITED TO US$50. Some places don't allow some of these limits, so they may not all apply to you.

Ending these terms

You can stop at any time by deleting the app. We can end your right to use the beta at any time, for example if you break these terms. When these terms end, you must stop using the beta and delete it. The sections on what you may not do, feedback, no warranty, our liability and the law that applies continue after that.

Changes to these terms

We may update these terms. The new version will have a new date at the top. If a change is significant, we'll email you before it takes effect. If you keep using the beta after that, you accept the new version.

The law that applies

These terms are governed by the laws of the State of New York, United States, without regard to its rules on conflict of laws. Any dispute about them or the beta will be decided only in the state or federal courts in New York County, New York, and you and we agree to those courts. If you live outside the United States, you keep any protections the law where you live gives you and that can't be waived by agreement.

The rest

These terms and our privacy policy are the whole agreement between you and us about the beta. If part of these terms can't be enforced, the rest still applies. If we don't enforce a part, we haven't given up the right to enforce it later. You can't transfer these terms to anyone else. We may transfer them to whoever takes over Best Light.
